## What Article 153⁷ covers

Paragraph 2¹ of Article 34 of the Organic Law of Georgia "On the National Bank of Georgia" sets the rule on expressing prices in lari. Article 153⁷ of the Code of Administrative Offences supplies the administrative liability for breaching that rule. If you put goods or services on the market, or commission advertising, and the way the price is expressed does not comply, the matter is dealt with under this article.

One point is worth settling at the outset. The substance of the rule — precisely how a price must be expressed — is not written in Article 153⁷ itself. It sits in paragraph 2¹ of Article 34 of the Organic Law, and that is where it has to be checked in any given case. The Code of Administrative Offences only attaches a sanction to that rule.

### Will I be fined the first time this is raised?

Paragraph 1 provides for a warning on the first occasion, addressed to the offeror or the advertising client. The GEL 1,000 fine under paragraph 2 arises only where the same act is committed repeatedly, so a first finding and a repeat finding are very different events.

### Why is the third episode five times more expensive?

Paragraph 3 fines each subsequent commission of the paragraph 2 act at GEL 5,000. The sequence is therefore a warning, then GEL 1,000, then GEL 5,000 on each further occasion.

### An agency produced the advertisement. Am I still responsible?

Paragraph 1 directs the warning at the offeror or at the advertising client — the person on whose order the advertisement was placed. Who occupied that role in a given episode is established from the contracts and placement records, which is why those documents are worth collecting immediately.

### Does an episode from years ago count as a repeat?

The text of the article does not fix any period for repetition. That answer therefore cannot be taken from the article itself and has to be examined on the file in your particular case.

### Where is the actual rule on how a price must be shown?

It is in paragraph 2¹ of Article 34 of the Organic Law "On the National Bank of Georgia". Article 153⁷ only supplies the penalty, so the substantive requirement has to be verified against the Organic Law rather than against the Code of Administrative Offences.
