## What Article 66⁵ actually covers

Article 66⁵ of the Administrative Offences Code of Georgia addresses one narrowly drawn situation: failure to comply with the requirements laid down by a decision of the Government of Georgia for removing plant species protected by Georgia's Red List from the natural environment. The wording repays close reading. The article does not declare an absolute ban on taking a protected plant from the wild. It assumes the opposite — that a lawful route exists, that a Government decision sets out the requirements governing that route, and that the offence consists precisely in not meeting those requirements. Every case built on this article therefore reduces to two questions: which specific requirement was treated as unmet, and whether that requirement was owed by you. Where the case file does not answer both clearly, that gap is where a defence begins.

### I picked plants while hiking in Georgia. Could this article reach me?

Article 66⁵ is not a general prohibition on picking plants — it penalises failure to meet requirements set by a Government decision on removing Red List species from the wild. Whether it reaches a particular incident depends on the species involved and on which requirement is said to have been breached. Those two points should be identified in the protocol; if they are not, that is worth raising.

### Is the GEL 500 fine charged per plant?

The article states a fine of GEL 500 and contains no per-item multiplier of any kind. How many separate offences are recorded, and on what basis, is a matter for the case materials rather than for the text of the article. Ask to see exactly how the charge has been framed before you pay anything.

### Does the article require intent?

The text does not distinguish between deliberate and careless conduct — it refers only to failure to comply with the requirements set by the Government's decision. Your state of mind is therefore not what the article turns on, though the surrounding circumstances still belong in your written explanation.

### I have already left Georgia. Can a lawyer act for me?

Yes — you can be represented, and the work starts from documents rather than from your physical presence. Send clear scans of every page of the protocol and the decision, plus any permit or correspondence you hold. Article 66⁵ sets no appeal route or time limit of its own — those come from other provisions of the Code — so send the papers promptly and have the position established from them.
