## What Article 153⁶ of the Administrative Offences Code covers

Article 153⁶ of the Code of Administrative Offences of Georgia establishes administrative liability for outdoor trading on the territory of the Tbilisi municipality without the corresponding permit. The norm is of local scope and applies only within the Tbilisi municipality. Its point is simple: trading in outdoor spaces without a permit is not allowed, and a breach of that rule is sanctioned — with a fine and with the confiscation of the object of the offence, that is, of the goods offered for sale.

The article is built of five parts, and the sanction grows stricter with the circumstances: disobedience, repetition and the use of a vehicle are each separate aggravating factors. The qualification of the case is therefore the first question that must be settled.

### What is the fine for street trading without a permit in Tbilisi?

For the basic offence — 50 GEL; with disobedience — 200 GEL or up to 7 days' arrest; on repetition — 300 GEL; using a vehicle — 1,000 GEL; using a vehicle with disobedience — 2,000 GEL or up to 7 days' arrest. In every case confiscation of the goods is provided.

### What counts as disobedience?

Failing to present an identity document or other identification data, or failing to comply with a verbal instruction given to stop the offence.

### If I only receive a verbal warning, do I keep the goods?

No. Under a note to the article, release from liability and a verbal warning do not relieve the violator of confiscation — the object is taken all the same.

### Does the article apply only to Tbilisi?

Yes. Article 153⁶ governs outdoor trading on the territory of the Tbilisi municipality. In other municipalities the matter may be regulated by different norms.
