## What termination of enforcement means

A ruling imposing an administrative penalty does not end with its issue — enforcement begins after that. Sometimes, though, a circumstance arises after which enforcement loses its legal foundation or simply loses its point. Article 286 of the Administrative Offences Code of Georgia exists for exactly those situations. It lists the cases in which the body or official that issued the ruling terminates its enforcement. The terminology matters here and is often confused. Termination is not the same as suspension, and it is not postponement. Where enforcement is suspended or postponed, it stops for a time and then resumes; where it is terminated, it does not continue. So if a circumstance covered by Article 286 has arisen in your situation, the question is not how much longer you have but whether enforcement should be carried on at all.

### How is termination different from suspension of enforcement?

Where enforcement is suspended or postponed it stops for a period and then resumes. Where it is terminated under Article 286, it does not continue. That is why identifying which of the two you are actually dealing with comes before anything else.

### The decision against me was annulled. Does enforcement stop by itself?

Article 286 lists annulment of the act establishing administrative liability as a ground for terminating enforcement. The decision is taken by the body that issued the ruling, so the document evidencing the annulment has to be put in front of that body.

### A relative died and an unpaid fine remains. Who has to pay it?

Article 286 provides that enforcement of the ruling is terminated upon the death of the person in respect of whom it was issued. The article itself does not regulate what happens to sums already paid, so that question has to be checked separately.

### Who do I apply to?

To the body or official that issued the ruling — the article places the duty to terminate enforcement on that body specifically. Its name appears in the ruling itself, which is where to start.

### Can other hardship count as a ground?

Article 286 lists specific grounds and does not tie termination of enforcement to any other circumstance. That does not mean no other legal route exists, but it would have to be assessed under different provisions of the Code.
