## What Article 55² is about and who it applies to

Article 55² of the Georgian Administrative Offences Code protects state-owned land from unauthorised appropriation. The norm covers two forms, and the wording joining them — "and/or" — matters: the offence is the unauthorised occupation of a plot of state-owned land, the use of land without a right of land use, or both together. If you have been fined under this article, the authority's position is that you occupied or have been using state land without the permission or the right to do so.

This page helps you understand what the article says exactly, what fines it provides for, and what it does not say. Land cases are emotional, because they often concern a plot that has been worked in fact for years; but for that very reason the facts and the documents must be assessed coolly — that is the only way to strengthen your position in the face of a fine.

### I was fined under Article 55² — will I lose the land as well?

Article 55² itself provides only a fine: 1,000 to 2,000 lari for a first offence and 3,000 to 3,500 lari on a repeat. The future of the plot is not regulated by this article and depends on other norms. That is a separate and no less important question to discuss with a lawyer.

### I have been using this land for years — does that not count as a right?

The article does not mention duration: the offence is unauthorised occupation and use without a right. Long factual use does not by itself create a documentary basis. But all the circumstances of the case matter, and assessing them is a job for a specialist.

### How much is the fine for a second offence?

The same act committed repeatedly is punished with a fine of 3,000 to 3,500 lari, compared with 1,000 to 2,000 lari for the first. What counts as a repeat is not stated in this article; it is defined by other norms of the Code.

### Will they also demand that I vacate the land?

Article 55² does not provide for that — it contains the sanction only. Any other demands concerning the plot appear from other norms and from the documents in your case. Read every document you receive carefully and consult a lawyer in good time.
