## The Concept of an Unmanned Aircraft System and the Regulatory Frame

The legal regulation of drones begins with a definition. The law states that an unmanned aircraft system is the totality of unmanned aircraft and the elements associated with their operation, while an unmanned aircraft is a flying apparatus on board of which no pilot is present. This definition matters because the entire subsequent regulatory logic is tied to it: treating the subject as a system means that the regulator assesses the apparatus together with its supporting infrastructure and not merely as a physical device, and the scope of obligations follows that breadth.

The rules for the registration and flight of unmanned aircraft, as well as for the operation, use and restrictions of unmanned aircraft systems and unmanned aircraft, are determined by a normative act of the agency. This means that the law sets the frame while detailed rules are born at the administrative level, and their current content must be verified in each specific case. In practice, this is the point at which general knowledge is no longer enough for a drone owner: the exact content of the operative normative act determines what must be registered, how flights are permitted and which zones remain closed.

## The General Rule of Registration and Its Exceptions

Every airworthy aircraft is subject to mandatory state registration with the issue of an appropriate certificate. A civil aircraft is registered in the state registry of civil aircraft or in the registry of ultralight aircraft, and the agency establishes the rules of registration, accounting and removal from the registry. A separate registry exists for state aircraft, and experimental aircraft are not registered in the state registry at all — they are recorded with the organisations carrying out test-design or scientific-research flights. An aircraft built by non-industrial means with a mass of not more than 1 000 kilograms (other than an ultralight) must be registered with the appropriate aviation sports organisation. For a drone, it is the identification of the correct registry and rules that decides where and how the apparatus must be accounted for.

### What is an unmanned aircraft system?

The totality of unmanned aircraft and the elements associated with their operation. An unmanned aircraft is a flying apparatus on board of which no pilot is present.

### Is every aircraft registered?

Every airworthy aircraft is subject to mandatory state registration. An aircraft built by non-industrial means with a mass of not more than 1 000 kilograms is registered with an aviation sports organisation.

### Which permits does the agency issue?

A permit for non-scheduled international air transportation and a permit for carrying out aviation work, in accordance with the law on licences and permits.

### Where should an operator start?

By distinguishing the category, purpose and planned activity of the apparatus: registration applies to every airworthy aircraft, while permits concern commercial and specialised cases. The details live in the agency’s normative acts.
