## Silicosis Litigation — the Framework of Georgian Law

Silicosis is an occupational disease connected with the processing of stone, sand and concrete: construction, stone production and ongoing works are its typical environment. It must be said plainly at the outset: Georgian law has neither a special statute for silicosis nor a class-action mechanism — the route is an ordinary tort claim, which covers multi-party participation through joint and several liability. The grounds are: Article 992 — a person who causes damage to another by an unlawful, intentional or negligent act is obliged to compensate it; Article 997 — the employer answers for his employee's unlawful act committed in the performance of service duties; and Article 998 — joint and several liability where several persons participate in causing the damage.

### Is there a separate silicosis statute?

No. Georgia has neither a special silicosis statute nor a class-action mechanism; the route is an ordinary tort claim — Articles 992, 997 and 998.

### What is joint and several liability?

Under Article 998, where several persons participate in causing the damage they answer as joint debtors; liable is not only the direct causer but also the instigator, the aider and the one who consciously profited from the damage.

### Who answers for service-related damage?

Under Article 997 the employer answers for his employee's unlawful act in the performance of service duties; where the employee acted without fault, no liability arises.

### Can moral damage be claimed?

Yes — under Article 413, where bodily injury or harm to health occurred, the victim may claim compensation for non-pecuniary damage.

### When does the limitation period start?

Under Article 1008 — from the moment the victim learned of the damage or of the liable person; the period is three years.
