## Interim Measures and Fighting Them

The application by a court of interim measures — including the seizure of property — is often the most sensitive issue for a business: accounts are blocked, property can no longer be sold, and the defendant must act. The Civil Procedure Code of Georgia regulates these measures with clear rules — from the requirements of the application to the deadlines for appeal and the compensation of loss. This page explains how the mechanism works and where the defendant's keys of defence lie.

### What is an interim measure?

A measure applied by the court, including seizure of property, securities and funds, securing the enforcement of the decision.

### Within what deadline is a ruling appealed?

Within 5 days without extension; an appeal against cancellation or change suspends enforcement.

### How does the law protect the defendant?

Through a guarantee of compensation — within up to 30 days, otherwise the measure is cancelled; loss from an unjustified measure is compensated by the plaintiff.

### What happens in a bank resolution regime?

On the National Bank's application, measures are suspended for up to 90 days; the ruling is issued within 1 day.

### Guarantee not provided?

The measure is immediately annulled.
