## Legal Grounds for Appealing a Permit Denial

A decision by the permit-issuing authority to refuse a permit is not the final word: the law gives the applicant two independent routes — an administrative appeal to a superior administrative body (official) and a lawsuit in court. This page explains in detail how each mechanism works, what happens to the contested decision after an appeal or a claim is filed, and what a well-built appellate position requires. Our recommendations rest on the norms of licensing and permit law that directly govern the appeal of refusals and the suspension of decisions, together with years of hands-on experience in administrative matters before Georgian authorities and courts.

### Who may appeal a permit denial?

A decision refusing a permit may be challenged by the person whose rights and obligations that act affects. The right is protected by law and does not lapse by default, although the deadlines for exercising it are fixed by other provisions of administrative law.

### Must the appeal be written or can it be oral?

An administrative appeal and a court statement of claim are written documents in which the demand and its grounds must be reasoned. An oral submission is insufficient, which is why the wording of the document carries decisive weight for the outcome.

### What outcomes can the appeal produce?

The examining superior body or the court may annul the act, amend it or leave it in force. The outcome depends on the quality of the argumentation, while suspension of the decision occurs only through a special separate decision of the examining authority.

### Why involve a lawyer in the process?

In permit cases both the deadlines and the precision of the argumentation are decisive: an experienced lawyer detects the violations, builds the position and defends your interest at every instance, which significantly increases the chances of a favourable result.
