## Scope and Legal Foundations of the Law

The first article of the Georgian Law on Gambling Games defines its subject: the law establishes the legal grounds for the organization and conduct of lotteries, gambling and profit-making games in Georgia, as well as for the supply of gambling and/or profit-making games. As a body of sectoral law it therefore covers games held at physical facilities, such as casinos, slot machine halls, gambling clubs and gaming halls; games organized through the internet, the telephone or specially equipped electronic means; and the supply of essential products and services that can influence the results of such games. If you intend to operate in this field, it is this law's conceptual apparatus that determines which activity falls under which permitting regime, and its definitions are applied consistently by the Revenue Service when examining permit applications.

### What does the Law on Gambling Games regulate?

The legal grounds for organizing and conducting lotteries, gambling and profit-making games, and for supplying games: definitions, permitted forms, player-protection institutions, control and liability.

### Where may gambling games be organized?

Only in a casino, a slot machine hall, a gambling club and/or the systemic-electronic form established by the law; a gambling tournament may also be held outside the licensed premises.

### Who is a prohibited person?

Employees of budgetary organizations, national regulatory bodies and the National Bank of Georgia, as well as members of families registered in the unified database of socially vulnerable families; they may not participate in the games.

### How is a gambling game distinguished from a skill game?

If the result depends wholly or partly on chance, the game is gambling; if the element of chance is excluded and the purpose is testing knowledge, intellect or dexterity, the law does not apply.

### Who controls the gaming business?

The Ministry of Finance controls every requirement of the law and of the regulation; the electronic control system is deployed and operated by the selected person under a contract with the Revenue Service.
