## Notary Services in Real Estate Transactions

In real estate transactions the notary’s role protects both parties: a certified signature gives the transaction reliability, and a properly concluded transaction becomes the basis for registration. When the notarial form is mandatory, when the written form suffices, and what happens on a breach of form — these are the questions every participant in a property deal should answer in advance.

Notarial activity is governed by a separate statute, and its details — fees, procedures, the scope of the notary’s competence — derive from that law. The Civil Code, however, defines the legal frame in which the notarial act operates: the requirements of form, the registration procedure and the consequences of breaching form. That frame is the subject of this page.

### When does a real estate transaction need written form?

A contract undertaking the transfer or acquisition of ownership of immovable property always requires written form; for that form, the signatures of the parties suffice.

### When is notarial certification needed?

In cases provided by law or agreed by the parties. A transaction submitted for registration, or the authenticity of signatures, must be certified — unless the parties sign at the registering authority before an authorised person.

### What happens on breach of a mandatory form?

The transaction is void. A voidable transaction is void from its conclusion if rescinded, and the right of rescission belongs to the interested person.

### Is notarial form mandatory for a will?

No — a will is written and admissible with or without notarial form. The notarial form means it is drawn up and signed by the testator and confirmed by the notary.

### Does a marriage certificate need an apostille for use abroad?

For Russia — no: under the Minsk Convention a Georgian marriage certificate is recognised without an apostille, a notarized translation suffices; for Hague Convention countries an apostille is affixed. The procedure for a specific country is handled by the service "Apostille of a Marriage Certificate and Its Recognition Abroad".
