## Copyright in AI-generated content under Georgian law

Commercial exploitation of material generated by artificial intelligence or created with its participation — publication, distribution, use in advertising — falls under the Law of Georgia on Copyright and Neighboring Rights. The law does not regulate the output of artificial intelligence as a separate category, so every decision rests on its general norms: where generated material incorporates a protected work, its use requires the consent of the author or other rights holder and the payment of a royalty. On this page we explain when use without consent is permitted, what a licence agreement must contain, and what compensation the law demands when the agreement is breached.

### Can generated material containing protected works be used commercially without consent?

As a rule, no. Use without consent and royalty is permitted only in the cases listed by law — for example quotation for scientific or informational purposes to a justified extent, with indication of the author and the source. Commercial-scale use does not fit that frame and requires the consent of the rights holder.

### How are the type of use and territory fixed in the agreement?

The licence agreement must contain an exact description of the work, the specific type of use, the term and territory, the royalty and the procedure for its payment. Types of use not provided for remain with the rights holder, and where no territory is indicated the agreement extends only to Georgia.

### What happens if the agreement does not state a term?

Where the term is not specified, the author or other rights holder may terminate the agreement after 3 years from its conclusion, notifying the licensee in writing 6 months before termination.

### What compensation can be claimed for breach of a licence?

The party that failed to perform or improperly performed an obligation under a licence agreement must compensate the other party for the damage caused, including lost profits.
