## Dealing with the supervisory authority: what a business must know

Engagement with the data protection supervisory authority often begins unexpectedly — with a subject's complaint or on the authority's own initiative. On this page we explain how the process runs and which deadlines are decisive. One important circumstance first: under the current redaction of the Law on Personal Data Protection, as amended by the law of 17 December 2025, data protection supervision is exercised by the State Audit Service — complaints, inspections and measures therefore occur in the name of that authority.

### Which authority examines data protection matters?

Under the current redaction it is the State Audit Service — the relevant amendment to the law entered into force on 17 December 2025. Complaints, inspections and measures occur in the name of this authority.

### How long does the examination of an application take?

The overall term is 2 months; by a justified decision it may be extended by 1 month. The decision on the measures to be applied is taken within 10 days of receiving the application.

### What materials may the authority demand?

Any document or information, including information containing state, tax, banking, commercial and professional secrets. The term is immediate; for complex retrieval, 10 working days, extendable by a further 10.

### Can a decision be appealed?

Yes — a decision of the General Auditor is appealed in court within 1 month of official notification. The appeal does not suspend execution: the decision is enforced once the court decision enters into force.
