1. ნორმატიულ აქტს უკუძალა აქვს მხოლოდ იმ შემთხვევაში, თუ ეს პირდაპირ არის დადგენილი ამ ნორმატიული აქტით.

2. ნორმატიულ აქტს, რომელიც ადგენს ან ამძიმებს პასუხისმგებლობას, უკუძალა არა აქვს.
