პირს, რომელსაც უფლება აქვს ისარგებლოს კოლექტიური ნიშნით, შეუძლია ამ უფლების დარღვევის თაობაზე სარჩელი შეიტანოს სასამართლოში მხოლოდ კოლექტიური ნიშნის მფლობელი გაერთიანების ნებართვით, თუ კოლექტიური ნიშნის დებულებით სხვა რამ არ არის გათვალისწინებული.
