ამნისტიის შეფარდების შესახებ მოკვლევისა და წინასწარი გამოძიების ორგანოების დადგენილებას ამტკიცებს პროკურორი დადგენილების გამოტანიდან 5 დღის ვადაში . ამნისტიის შეფარდების საკითხის სასამართლოში განხილვისას პროკურორის მონაწილეობა სავალდებულოა .
