League-level general sponsorship in Georgia turns on who is entitled to sell the representative and advertising rights of a given sport, and which funds count as the league's lawful revenue. The Law on Sport supplies three anchors: the status of the national federation, the form of the professional league, and the financing rules that name advertising and sponsor income as a lawful source.

The Federation — the Sole Governing Body and the Seller of Rights

The national sports federation of Georgia is a non-commercial legal entity of private law created on the basis of the Civil Code, which conducts its activity under the law, other normative acts of Georgia, international sports federations and its own statutes. The federation is the sole governing body in the respective sport and answers for its development; it represents the sport both inside the country and beyond its borders. This is the legal foundation on which league-level sponsorship rights are acquired from the federation or a structure authorized by it — for a sponsor it is decisive that the counterparty is this sole governing body. The federation's status is granted to an association whose founding documents satisfy Georgian legislation and the respective international federation, and its competence extends over the whole territory. Its supreme organ is the assembly, at least three quarters of whose members must be represented by sports organizations, and it is within this assembly that decisions touching sponsorship rights are taken. The president of the federation must be a citizen of Georgia with higher education, high reputation and no criminal record — governance requirements a sponsor verifies in due diligence.

The State Order and High-Achievement Sport

Directly connected to league sponsorship is the law's norm on high-achievement sport and the state order. For the preparation of highly qualified athletes, specialized institutions are created, their structure and status determined by the ministry and the respective national federation. The state order for the preparation of highly qualified athletes is formed through agreements concluded with the respective national sports federations or other sports organizations — this is the lawful channel of public money into the league's ecosystem, which is added to, and does not replace, sponsorship revenue. The federation fulfils the state order and cooperates with the ministry on a contractual basis; the preparation of athletes within the national team is carried out on the ministry's demand with funds allocated from the state budget. For a sponsor this architecture means clarity: public financing and sponsorship money run on parallel tracks, each with its own reporting.

The Professional League and "Athlete" as a Profession

The object of general sponsorship — the professional league — is formed in the shape the law describes: a professional sports league, association, club and other professional sports organization is created and functions in accordance with legislation. Inside the league operates the athlete regime: "athlete" is a profession; an athlete for whom sport is the main source of income is a professional; and his or her professional activity is carried out under labour legislation. The procedure for concluding a contract with an athlete and the conditions of participation in competitions on professional grounds are determined by Georgian legislation, the statutes of international sports organizations and other regulatory documents — for a general sponsor this means that together with the league's advertising assets it is affected by the rules governing players' contracts and competitions. A deal touching the image of the league and its players must be coordinated with the contract framework the law establishes.

Financing — Advertising Income and Sponsor Funds as a Lawful Source

The law's financing norm is the foundation of the sponsorship deal. For the financing of sport, alongside budget funds, use is made of the contributions of state, private and public organizations, institutions and individual persons; the profit derived from one's own sporting, commercial-economic, advertising and intermediary activity; and funds received from sponsors and other assistance. A general sponsor's contribution is thus a lawful revenue source for the league, named directly by the law. The same norm protects the principle of independence: funds received from non-budget sources have no influence on the amount of state-budget allocations for sport — sponsorship money does not reduce budget financing. The earmarking rule stands here as well: the use of budget and non-budget contributions designated for sport for other purposes is inadmissible — they must be consumed only for the development of sport. The state budget allocates targeted funds for national teams and international events, including the rewarding of winners and prize-winners — the general-sponsorship deal fits into this system, and its description in the agreement should not run against transparency.
