Initial Military Registration — Legal Support

When and by whom is a person placed on initial military registration?

The structural unit of the municipality carries out a person's registration from 1 January to 30 April of the year in which the person turns 17. Registration is formally concluded by an individual administrative-legal act of the mayor or, in a Tbilisi district, of the district head.

I have not yet turned 17, but I received a summons. Is the registration unlawful?

The documents must be checked. The law allows registration even of persons between 17 and 27 years of age who were not on registration, and in that case the municipality registers them immediately upon detection. If your age is outside these limits, the lawfulness of the summons should be assessed together with a lawyer.

Who is not subject to military registration?

Under the law, registration does not apply to persons released from military duty, women without a military-accounting specialty, persons in military service, employees of the relevant state agencies, persons in non-military, alternative or labor service, persons who have reached the reserve age limit, and persons serving a criminal sentence of imprisonment.

I voluntarily enrolled in the reserve of the defense forces. Does this release me from compulsory service?

No. A person who before the age of 27 voluntarily enrolled in the reserve is not removed from pre-conscript registration, and if the right to release from call-up or to deferral ceases, he becomes subject to call-up for compulsory military service.

Initial (pre-conscript) military registration is the first stage in the system of military duty under Georgian legislation. It is at this stage that the legal relationship between a citizen and the state in military-administrative matters begins: the competent authority identifies the person, records his or her registration data and determines the status connected with future military service. Applying the law correctly at this stage matters both to the citizen and to the state, because a mistake made here can later grow into disputes over call-up, deferral or release from military duty.

The Essence and Types of Military Registration

Under Georgian law, every citizen is obliged to be on military registration. The law distinguishes the following types of military registration: pre-conscript (initial) military registration, reservist military registration and special military registration. Reservist registration is carried out in accordance with the Georgian law on the reserve of the defense forces and military reserve service. Pre-conscript, or initial, military registration is the type that concerns every citizen reaching the age of military duty.

The registration of a citizen, pre-conscript or reservist is carried out according to his or her place of registration, while a person who has no place of registration is registered according to his or her actual place of residence. Registration is carried out by the municipality or, in Tbilisi, by the Tbilisi district. In practical terms this means that the first administrative body you deal with in registration matters is the local self-government or district authority.

Procedure and Timing of Initial Registration

Pre-conscript, that is initial, military registration is carried out by the municipality or the Tbilisi district, and it is formalized by an individual administrative-legal act of the mayor of the municipality or the head of the Tbilisi district. The existence of this act matters: it is precisely the document whose lawfulness may later be examined through the procedure established by legislation.

The law also sets out the calendar framework of registration. The relevant structural unit of the municipality carries out a person's military registration from 1 January to 30 April of the year in which the person turns 17, with the exception of a special case provided for by the law. Placing on registration is possible for persons between 17 and 27 years of age who are not on military registration; the municipality or the Tbilisi district registers such persons immediately upon their detection.

A person placed on military registration is called a pre-conscript until the age of 27, except for a person who has served compulsory military service or for whom it is deemed served. In other words, the status of a pre-conscript is temporary: it ends either by completing compulsory military service or by reaching the statutory age limit.

Who Is Not Subject to Military Registration

Although being on registration is the general rule, the law establishes exceptions. The following persons are not subject to military registration:

  • persons released from military duty by this law;
  • a woman who has no military-accounting specialty;
  • a person in military service;
  • employees of the Prosecutor's Office of Georgia and of the Ministry of Internal Affairs, including contractual and professional staff, as well as employees of the State Protection Special Service, the State Security Service, the Ministry of Justice, the Intelligence Service and the relevant services of the Ministry of Finance who hold state special ranks;
  • a person in non-military, alternative or labor service;
  • a person who has reached the statutory age limit for being in the reserve;
  • a person serving a criminal sentence of imprisonment.

This list shows that registration disputes very often turn on whether a particular person falls within one of these categories. For example, the status of contractual professional service in a state agency, or the existence of a military-accounting specialty, may prove decisive. That is why each case must be verified on the basis of documents.

The Citizen's Obligations Connected with Registration

In matters of military registration, a person is obliged to appear at the municipality or the Tbilisi district upon summons by an authorized official. This obligation applies to every person on registration, and its violation may be connected with sanctions defined by other norms of the law. Before refusing to respond to a summons, however, it is advisable to consult a lawyer: it is often discovered that the person has a ground for release from registration or another exception that can be documented from the outset.

Special Cases: The Reserve and the Cessation of a Ground for Release

The law separately regulates the position of persons who, before reaching the age of 27, voluntarily enroll in the reserve of the defense forces. Such a person is not removed from pre-conscript military registration, and if the right to release from call-up or to deferral of call-up ceases, he becomes subject to call-up for compulsory military service. Voluntary enrollment in the reserve therefore does not in itself release a citizen from the obligation of compulsory service.

The rule for the case where a ground for release from registration or for non-subjection to registration ceases or is annulled is equally important: in such a case the municipality or the Tbilisi district is obliged, in the manner prescribed, to place the person, pre-conscript or reservist on military registration. The placing on registration of a person of reserve age who was not on registration is likewise carried out by the municipality or the Tbilisi district.

Military Registration of Internally Displaced Persons

The law devotes a separate norm to the military registration and the organization of call-up for compulsory military service of persons internally displaced from the Autonomous Republic of Abkhazia. Until the full restoration of the jurisdiction of Georgia over the territory of the Autonomous Republic of Abkhazia, this organization is provided by the Government of the Autonomous Republic of Abkhazia, with the exception of persons displaced from the Azhara municipality, whose registration and call-up are organized by the Azhara municipality. Displaced persons therefore have their own administrative framework of registration, which in practice often requires additional circumstances to be taken into account.
