სამსახურებრივ-საშტატო იარაღი პირს მიეცემა სარგებლობაში, თუ მას აქვს ამ იარაღის ტარების ინდივიდუალური ნებართვა. ინდივიდუალურ ნებართვას გასცემენ საქართველოს შინაგან საქმეთა სამინისტროს ორგანოები თავისი ნორმატიული აქტების შესაბამისად იმ უწყების შუამდგომლობის საფუძველზე, რომლის მუშაკებსაც აქვთ სამსახურებრივ - საშტატო იარაღის ტარების უფლება.
