Alimony Arrears — Legal Grounds and Framework

Alimony that has not been enforced in time turns into arrears, and its recovery becomes the subject of its own, separately calculated strategy. The statutory basis is clear: a person who has the right to claim alimony may, in the manner established by law, at any time until that right is lost, demand the recovery of alimony through the court, regardless of the period that has elapsed since the right arose. The obligation to pay alimony is imposed only for the future, from the moment the claim is filed in court. Alimony for the past period may be recovered within the frame of three years, provided the court establishes that before filing the claim measures were taken to obtain support, but the alimony was not received because the obliged person evaded payment. Under an enforcement sheet, arrears of alimony for the past period may be recovered for not more than three years before the submission of the enforcement sheet for execution. The law, however, contains an exception: where, in connection with the search for the debtor, it proved impossible to attach the alimony under the enforcement sheet submitted for execution, the arrears are recovered for the whole past period, regardless of the expiry of the limitation period and regardless of the recipient of the alimony having reached majority. Calculating the Arrears — From Which Sum It Is Counted

Arrears of alimony are determined from the actual salary (income) received by the debtor in the period during which no enforcement took place. If the debtor was not working during that period and did not submit documents confirming his salary (income), the arrears are determined according to the salary (income) he was receiving at the time of the recovery of the arrears. In practical terms this norm means: against the debtor's hidden income or undocumented periods there is a statutory calculation rule, and its correct application decides the concrete sum.
