When is notarial form mandatory for a consent?

The Framework of the Notarial Act (Article 38)

Article 38 of the Law of Georgia on the Notarial System sets out the list of notarial acts, of which several positions concern the formalisation of consents and declarations:

the notary certifies transactions in cases established by law or by agreement of the parties — meaning that a consent, as part of a transaction, may be certified notarially both where the law so requires and where the parties so choose;
the notary certifies the authenticity of a signature on a document — the form used for declarations submitted in a person's name;
the notary transfers a person's declaration and notice to another person — the act needed where a consent or declaration is addressed to someone and the fact of its receipt must be confirmed.

Under the same article, the notary provides parties with legal advice in connection with notarial acts and, at their request, prepares drafts of documents; beyond that, the notary performs other notarial acts provided for by Georgian legislation. Which specific consent requires notarial form is determined by the norms that themselves demand the consent; we verify that link against every detail of your transaction.

Verification of Identity, Authority and Capacity (Article 48)

Article 48 establishes the system of checks that filters every notarial act. When performing a notarial act, the notary establishes, on the basis of identity documents, the identity of the persons — or their representatives — who request the act. Where the law so provides or the parties agree, upon certifying a transaction the notary verifies the authority and capacity of the participants; and where the transaction is concluded through a representative, the representative's authority as well.

Moreover, the notary has the right to request from an institution, enterprise or organisation the documents necessary for performing the notarial act. In practice this means that collecting the documentation correctly in advance is the main condition for an unproblematic notarial act — and that is exactly where our role begins.

Fees: What the Tariff Schedule Establishes

The cost of notarial acts is set by a separate normative act — the schedule of fees for notarial actions. Under subparagraphs 13–15 of Article 29 of that schedule, the relevant positions connected with consents and declarations carry fees of GEL 3, 1 and 2; which subparagraph matches your case depends on the type of act — certification of a signature's authenticity or the transfer of a declaration.
