Appeal of a Parking Fine and Challenging a Vehicle Evacuation

Parking fines and vehicle evacuation in Georgia are regulated by three different regimes: separate articles of the Administrative Offences Code operate for Tbilisi, for Batumi, and for the remaining municipalities, while the caps on evacuation costs are fixed by a distinct norm. When preparing a complaint, the first question is therefore which article and which part were applied against you: this alone determines the amount of the fine, the authority to tow the vehicle, and the sum you may lawfully be charged for its return. We reconstruct this chain from the documents and build the position for challenging both the fine and the evacuation.

Fines in Tbilisi

Within the administrative boundaries of Tbilisi Municipality, violations of parking rules are punished by a dedicated article, and under the wording in force since 1 May 2026 the main rates are these:

  • standing at a parking place without paying the fee established by the municipal representative body — GEL 50;
  • parking at an electric-vehicle charging place without connecting to the charging device — GEL 100;
  • using a parked vehicle for income-generating activity where the place is not designated for it — GEL 100, and repeating the same offence after being sanctioned — GEL 200;
  • parking at a place designated for persons with disabilities or obstructing movement on a ramp — GEL 200;
  • standing at a place with a vehicle type other than the one designated by the municipality — GEL 100;
  • standing or stopping on a sidewalk or pedestrian crossing — GEL 100 (from 1 May 2026);
  • violating the prohibitory sign “Stopping at a fire hydrant is prohibited” — GEL 200 (from 1 May 2026);
  • any other violation of the parking rules — GEL 50.

If the fine is not paid within the period allowed for voluntary performance, a surcharge of double the imposed fine is assessed, and if it remains unpaid within 30 days of assessment, measures to secure payment of the fine and the surcharge are taken — which is why complaint preparation is planned together with the payment deadline.

Batumi and the Remaining Municipalities

Within the administrative boundaries of the self-governing city of Batumi, violating the parking organisation rules established by the representative body is punished by a fine of GEL 100 for an individual and GEL 200 for a legal entity; if the violation remains uncorrected within two days after the fine, the amounts become GEL 200 and GEL 400 respectively. Standing at a parking place without paying the established fee and other violations of the parking rules have been punishable by GEL 50 since 1 May 2026 (previously these cases carried GEL 10), while violations connected with places for persons with disabilities carry GEL 200. The surcharge for unpaid fines under this article is set at up to GEL 150, and GEL 200 for the disability-place case.

In the remaining municipalities, standing without paying the fee and other violations of the parking rules carry GEL 10 — except under the amendment in force from 1 May 2026, under which in Kutaisi, Mtskheta, Rustavi, Gori, Telavi, Zugdidi, Poti, Akhaltsikhe, Ozurgeti or at any resort these violations are punished by up to GEL 50; violations connected with places for persons with disabilities carry GEL 200. It is precisely this detailed structure that makes an appeal start with a precise check of the classification.

Grounds for Evacuation and the Defence Lever

Everywhere, evacuation is provided alongside wheel blocking as an alternative, but the authority to use it is precisely circumscribed. Under the general municipal rule, if a vehicle stands at a parking place without payment for more than 12 hours, or commits a charging-place, disability-place or designated-type violation, the vehicle may be moved to a special guarded pound or have its wheels blocked — but only where the parking sign carries the corresponding notice. This is the main defence lever: in the absence of such a notice the authority to tow becomes doubtful, and that circumstance is written into the complaint as a separate element.

A different rule applies where the driver is not at the vehicle or refuses to move it and the vehicle obstructs traffic or creates an accident situation — evacuation then still depends on the notice, while for a violation committed on a sidewalk the vehicle is towed regardless of any notice from 1 May 2026. Together with the authority to issue the ticket, the complaint always examines who actually recorded the fact: the law empowers the municipal representative body to determine the unit or person that will record the fact of the offence on video or photo for forwarding to the ticket-issuing authority — this is a delegated power, and the correctness of its use is a separate question in the appeal.

Transport and Storage Costs

Evacuation costs are capped by law: for a passenger car, motorcycle, quadricycle or moped, the fee for transport to the special pound and for blocking may not exceed GEL 300, and for other vehicle types GEL 800; storage is capped at GEL 20 and GEL 100 per day respectively. Demanding more than these caps is plainly contestable. The vehicle is returned to the owner immediately upon presentation of a document confirming payment of the transport and storage fee, the registration certificate or a power of attorney, and an identity document — and where this chain is broken, the right to prompt return is defended by complaint.

Appeal: Forum and Deadlines

A decision imposing a fine is appealed to a superior organ (superior official), whose decision is in turn appealable in court; a route directly to the district (city) court also exists. The complaint is filed with the organ that issued the decision and is forwarded with the case within 3 days; no state duty is payable on appeal. The deadline is 10 days from handing a copy of the decision to the party, restorable on application where missed for a valid reason. Where the holder of the vehicle cannot be identified, liability falls on the owner — a circumstance that itself often becomes the central issue of the complaint.
