What Threatens an Unpaid Fine
The offender must pay the fine within 30 days of delivery of the copy of the decision or, for an on-the-spot fine, of the penalty receipt. Once that window has run out, a surcharge is imposed for the voluntary fulfilment that never happened: double the amount of the imposed fine, but not more than 500 GEL. The surcharge is an independent payment obligation, and its clock starts on the day the payment period expires.
For the violations listed in the corresponding part of the Code, the person has a further chance: within an additional 30 days after the expiry of the first window, the fine may be paid together with the surcharge. That is the last window that protects against a driving-licence suspension — which is why its exact calculation and documentary fixation becomes contested terrain from day one.
Replacement of the Fine with a 6-Month Suspension
If the fine or the surcharge remains unpaid even in that additional period, the fine is replaced with a suspension of the right to drive a vehicle for 6 months. After the suspension period expires, the driver gets the driving right back, and passing an examination for its restoration is not mandatory.
One more rule matters greatly: payment of the fine, or its replacement with a suspension, does not release the person from paying the surcharge. Even after the replacement, the surcharge remains an obligation — something that must be weighed clearly when deciding how to act.
When the Surcharge and the Suspension Are Cancelled
If the fine did not reach the state budget in full because of the deduction of the fee of the bank or of the electronic payment facility — which led to a surcharge and to a suspension of the driving right — then, once the person tops the amount up to the full figure, the surcharge is cancelled, the suspension decision is cancelled too, the driving right is restored and the licence is returned.
The suspension decision is cancelled and the licence is returned where, before the expiry of the suspension period, the person pays double the amount of the fine and the surcharge — for a fine not exceeding 100 GEL — or one and a half times the amount of the fine and the surcharge where the fine exceeds 100 GEL, but not more than 2000 GEL. These two repair mechanisms are often cheaper than waiting out the full term.
Execution of the Suspension and Reduction of Its Term
A decision on the suspension of the driving right is executed by officials of the internal affairs bodies; it counts as executed from the day it enters into legal force, the licence is taken from the person, and the suspension period is counted from the delivery of the decision. The rules on suspension, reduction, restoration and the return of the licence are defined by the Minister of Internal Affairs.
Where a person committed for the first time an offence punished with a temporary suspension of the driving right, the organ that imposed the sanction may, taking into account the personality and the family situation of that person, reduce the suspension period; such reduction is admissible only after at least half of the appointed term has elapsed.
