მოსამართლის თანამდებობა შეუთავსებელია ნებისმიერ სხვა თანამდებობასთან და ანაზღაურებად საქმიანობასთან, გარდა საქართველოს კონსტიტუციით დადგენილი გამონაკლისისა. მოსამართლე არ შეიძლება იყოს პოლიტიკური გაერთიანების წევრი, მონაწილეობდეს პოლიტიკურ საქმიანობაში.
