The Institution of the Selected Person
The technical control of the Georgian gambling business is built around one central institution. The third article of the law defines the selected person — the entity selected by the Revenue Service for the purpose of deploying and operating the electronic control system of the gambling business. It is precisely that person which issues the authorization certificate — the document confirming the compliance of a game and of certain essential products with the standards of the minister of finance. The operator named in the title performs this function — which means the local certification route begins precisely from this institution.
The legal foundation of the institution is a contract: on the basis of a contract concluded with the Revenue Service, the selected person is obliged to deploy the electronic control system and ensure its operation in accordance with the procedure established by the minister of finance. The contract is concluded for a term of no more than 15 years, and the rights and obligations of the parties are determined within it.
System Requirements and Control
The law also establishes the technical boundaries of the system: the server of the selected person must be placed on the territory of Georgia; the minister of finance establishes requirements for the electronic control system; and through the system are controlled the fulfillment of permit conditions and of the requirements of the legislation by the organizer of a gaming machine, of a systemically-electronically organized gambling and/or profitable game and by the organizer of a totalizator.
The supervisory layer is also defined: under the thirty-sixth article of the law, the Ministry of Finance of Georgia is obliged to impose control over the fulfillment of the requirements of every point of the law and of the rules of the games — the regulations. Thus the local route is two-sided: on the one hand, the certification and system of the selected person; on the other, the ministry's control over the rules.
The Practical Route of Authorization
For an operator the route looks like this. First: a preparatory assessment — the compliance of the product with the standards of the minister of finance, established by his normative acts. Second: the examination — where the operator uses a system created with its own resources, the selected person examines it and issues a certificate; the procedure and conditions of issuing the authorization certificate are established by an act of the minister of finance.
Third: the layer of integration and equipment — the placement of devices and connection to the control system. The government is entitled to establish additional requirements for the organizer and the supplier for the purpose of the deployment and functioning of the system, and their non-fulfillment is deemed a violation of permit conditions. Fourth: the fees — first-time examination, certificate, equipment, operation — whose types are enumerated by law, while the amounts are set by a government act.
The value of the local route lies in its predictability: since the rules of certification, integration and fees are within the types defined by law, every stage of the project is planned in advance. Our approach stands on three lines: first, an assessment reflecting the standards; second, the technical assignment of examination and equipment; third, a budget of costs in one-time and ongoing layers. Such a structure makes the route transparent and gives negotiations a precise foundation.
A final note: the local institution works together with foreign practice — independent testing is the preparatory layer, while authorization is the point of legal decision. Separating the two in planning guarantees that the project does not stall at the laboratory stage and keeps the permit calendar.
In closing we emphasize once more: every element of the local route — the contract, the server, the standards, the examination, the certificate, the fee — is part of a structure defined by law, and knowledge of this structure gives the operator grounds to limit assessments with facts at every stage of negotiations. A project that proceeds by this grid does not encounter an unexpected requirement at any stage, and every cost is seen in advance rather than discovered mid-course.
Frequently Asked Questions
Who is the selected person?
The entity selected for deploying and operating the electronic control system — it issues the authorization certificate, and the operator's technical route proceeds precisely to it.
Where must the server be?
The server of the selected person must be placed on the territory of Georgia — a technical parameter established by law.
Who controls the system itself?
The minister of finance establishes requirements for the system, and the ministry regulates control over the requirements of the law and the regulations.
What requirements may be imposed on an operator?
The government may establish additional requirements for deployment and functioning; their non-fulfillment is a violation of permit conditions.
