მუხლი 20. მიწის ნაკვეთისა და შენობა-ნაგებობების კვლევა

2.კვლევების მიზანია მიწის ნაკვეთის ბუნებრივი და ფიზიკური პირობებისა და მახასიათებლების გარემოზე ზემოქმედების ფაქტორების განსაზღვრა და მათი ცვლილებების პროგნოზირება.
3.ცალკეულ სახეობათა კვლევების განხორციელების აუცილებლობა, მისი შემადგენლობა, მოცულობა და ჩატარების მეთოდი დამოკიდებულია: ა) შენობა-ნაგებობების დანიშნულებასა და სახეობაზე; ბ) შენობა-ნაგებობების კონსტრუქციულ თავისებურებებ-ზე, ტექნიკურ სირთულესა და ისეთ პოტენციურ საშიშროებაზე, რამაც შესაძლოა გამოიწვიოს შენობა-ნაგებობის დეფორმაცია; გ) ტოპოგრაფიული, საინჟინრო-გეოლოგიური, ეკოლოგიუ-რი, კლიმატური პირობების სირთულეებზე, აღნიშნული პირო-ბების შესახებ არსებული კვლევების შედეგების ხარისხსა და ხელმისაწვდომობაზე.
4.ახალი მშენებლობისა და არსებული შენობა-ნაგებობის რეკონსტრუქციისას უნდა მოხდეს იმ არსებულ შენობა-ნაგებობაზე ზემოქმედების შეფასება, რომლის მომიჯნავედაც დაგეგმილია მშენებლობა. იმ შემთხვევაში, თუ დაგეგმილმა სამშენებლო სამუშაოებმა შესაძლოა გავლენა მოახდინოს მათ მდგრადობაზე, მაშინ უნდა მოხდეს ამ შენობა-ნაგებობის მდგრადობის გამოკვლევა.
5.ჩამოყალიბებული განაშენიანებით შეზღუდულ პირობებში მშენებლობის განხორციელებისას დამკვეთმა, დამპროექტებელმა და მშენებელმა უნდა უზრუნველყონ ყველა საჭირო ღონისძიების განხორციელება, რათა გამოირიცხოს მათი მიზეზით მიწის ნაკვეთის მოსაზღვრე შენობა-ნაგებობების კონსტრუქციების დეფორმაცია და დაზიანება, წინააღმდეგ შემთხვევაში, დამკვეთი ვალდებულია ასეთი ფაქტის დადასტურებისას: ა) საკუთარი ხარჯებით გამოასწოროს მიწის ნაკვეთის მოსაზღვრე შენობა-ნაგებობების კონსტრუქციების დეფორმაცია და დაზიანება; ბ) იმ შემთხვევაში, თუ ვერ ხერხდება მიწის ნაკვეთის მოსაზღვრე შენობა-ნაგებობების კონსტრუქციების დეფორმა-ციისა და დაზიანების გამოსწორება, მაშინ მოახდინოს შესაბამისი კომპენსირება მოსაზღვრე დაზიანებული შენობა-ნაგებობის მესაკუთრესთან შეთანხმების საფუძველზე.
6.ჩამოყალიბებული განაშენიანებით შეზღუდულ პირობებში მშენებარე შენობა-ნაგებობების დამკვეთებმა წინასაპროექტო სამუშაოების დროს საჭიროების შემთხვევაში უნდა ჩაატარონ მომიჯნავე შენობა-ნაგებობების მდგრადობის სათანადო კვლევა მისი მდგომარეობის დაფიქსირებისათვის, განსაზღვრონ არსებულ ობიექტებზე დაგეგმილი სამშენებლო სამუშაოების შესაძლო ზემოქმედების ხარისხი.
7.დაპროექტებისათვის უფლებამოსილმა შესაბამისმა პირმა, თუ ამის საფუძველს იძლევა კვლევების შედეგები, მშენებლობის ორგანიზაციის პროექტში უნდა გაითვალისწინოს სპეციალური ღონისძიებები, რომლებიც უზრუნველყოფს მომიჯნავე შენობა-ნაგებობების არსებული მდგომარეობის შენარჩუნებას.
